As we mentioned in our most recent  blog , the 2022 COVID-19 Supplemental Paid Sick Leave went into effect on February 19, 2022 for California employers with more than 25 employees.

The California DLSE just released the required 2022 COVID-19 Supplemental Paid Sick Leave Poster which should be in all workplaces and emailed to remote workers.

The DLSE also just released its FAQs for the new 2022 COVID-19 Supplemental Paid Sick Leave. Some of the critical issues addressed in these FAQs include:

  • How employees can make requests for retroactive 2022 COVID-19 Supplemental Paid Sick Leave for leave between January 1, 2022 and February 19, 2022. See FAQ #13.
  •  What type of documentation employers may require from employees. See FAQ #14, #19, and #20.
  • What COVID-19 tests are acceptable under 2022 COVID-19 Supplemental Paid Sick Leave. See FAQ #21.
  • Whether employers may count paid sick leave provided under local paid sick leave ordinances towards the 2022 COVID-19 Supplemental Paid Sick Leave requirement. See FAQ #27.
    It is likely that the Labor Commissioner will update the FAQs with further clarifications as employers begin to implement the requirements and additional questions arise. Employers should review the full FAQs and regularly check for any updates to the FAQs.
